LIMITATION OF LIABILITY & TERMS OF USE AGREEMENT

1. Acceptance of Terms

By accessing the Gemini the Madman LLC website and/or purchasing any product from this store, you (the "Customer") agree to be bound by the following terms and conditions. If you do not agree to all terms, you are prohibited from using this site or purchasing our products.

2. Legal Use & Compliance

All products sold by Gemini the Madman LLC, including but not limited to smell-proof bags, lockable cases, and apparel, are intended for legal use only.

  • It is the sole responsibility of the Customer to adhere to all local, state, federal, and international laws regarding the possession and use of the items purchased.
  • Gemini the Madman LLC does not condone, promote, or encourage the use of our products for any illegal activities.

3. Limitation of Liability

To the maximum extent permitted by law, Gemini the Madman LLC and its owners, employees, or affiliates shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from:

  • The use or misuse of any product purchased.
  • Legal repercussions, fines, or law enforcement actions taken against the Customer.
  • The failure of security features (such as combination locks) to prevent theft or unauthorized access.
  • The failure of odor-containment technology to prevent detection by humans or animals.

4. No Guarantee of Performance

While we vet our products for high quality, Gemini the Madman LLC provides products "as is."

  • Locks: Our lockable gear is a deterrent only. We do not guarantee that our products are "theft-proof."
  • Odor Protection: Scent-trapping performance varies based on environmental factors, the volume of the contents, and the maintenance of the carbon lining. We do not guarantee 100% scent containment in all circumstances.

5. Assumption of Risk

The Customer explicitly assumes all risks associated with the use of the products. This includes, but is not limited to, risks of property damage, legal seizure, or personal injury. By completing a purchase, you waive any right to bring a lawsuit or legal claim against Gemini the Madman LLC for damages arising from product performance or usage.

6. Indemnification

You agree to indemnify and hold harmless Gemini the Madman LLC from any claims, losses, or legal fees arising from your breach of these terms or your violation of any law or the rights of a third party.
